Terms of Service & Privacy Policy

1. About Constellate
Constellate (“we”, “us”, the “Service”) is an AI-powered learning platform, operated independently from the United Kingdom.
By using the Service, or by creating an account or making a purchase, you agree to these Terms and to the Privacy Policy in section 12, which forms part of them. If you do not agree, please do not use the Service.
2. The Service
Constellate teaches through guided AI conversation: short sessions, one concept at a time, with your progress and the things you write kept for you. The exact features may evolve over time.
The Service is intended for adults aged 18 and over. By using it, you confirm you meet this requirement.
3. AI disclosure
The Service is powered by large language models from third-party AI providers. You acknowledge that AI-generated responses are not the views of Constellate, may contain errors or omissions, and are not professional advice of any kind, including legal, medical, financial, or psychological advice. Do not rely on the Service where professional advice is needed.
4. Mental health and wellbeing
The Service is an educational platform, not a mental health service, therapy, or crisis resource. If you are experiencing a mental health crisis, please contact the emergency services or a crisis support line appropriate to where you are.
If a learning session ever feels distressing, stop the session and seek appropriate support. You are responsible for deciding whether the Service is appropriate for you and for how you act on anything it says. To the extent permitted by law, we accept no liability for emotional or psychological effects arising from use of the Service, or for decisions you take in reliance on session content.
5. Accounts and progress
You can use the Service without an account; anonymous progress is saved to your device and can be lost if your browser data is cleared. Signing in with a magic link (no password) attaches your progress and any purchases to your email address so they follow you across devices. You are responsible for the security of your email account and of devices you use to access the Service.
6. Payments, refunds, gifts and referrals
Paid courses are sold at the price displayed at the point of purchase. Payments are processed by Gumroad, Inc. as the merchant of record; your purchase is also subject to Gumroad’s own terms, and charges will appear from Gumroad. A purchase attaches to the email address used at checkout: sign in to the Service with that same address and the course unlocks.
You are entitled to a full refund within 14 days of purchase, provided you have not completed the course. Once a course is completed, the digital content has been delivered in full and no refund is issued except where the law requires. Nothing in these Terms affects your statutory rights.
You can buy a course as a gift for someone else: the gift attaches to the email address you name, and unlocks when its owner signs in with that address. The 14-day refund right belongs to the purchaser and applies provided the gifted course has not been completed. Please only gift to people who will be glad to hear from us.
We may offer a referral programme: when someone who arrives through your invite link goes on to make a purchase, you may be offered a reward, such as a course for yourself or to pass on as a gift. Referral rewards are discretionary, have no cash value, may change or be withdrawn at any time, and are void where abused, including self-referral or automated sharing.
7. Intellectual property
All content of the Service, including its courses, teaching design, visual design, and software, is owned by or licensed to Constellate and protected by intellectual property law. You may not copy, distribute, or create derivative works from it without written consent.
Text you write during sessions remains yours. You grant us a non-exclusive, royalty-free licence to use it to provide and improve the Service, including generating your Flash artefacts. We will never sell your content. Your Flashes are your personal learning record; you are welcome to share them for personal, non-commercial purposes.
8. Acceptable use
You agree not to: attempt to extract or replicate the Service’s underlying prompts, methods, or course content; submit unlawful, harmful, or abusive content; circumvent security, rate limits, or the payment gate; access the Service with automated tools or scrapers; or use the Service commercially without written consent. We may suspend or terminate access for violations.
9. Liability
You use Constellate at your own risk: you are responsible for how you use the Service and for anything you decide or do as a result. The Service is provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law, we are not liable for indirect or consequential losses, and our total liability in connection with the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or fraud.
10. Changes
We may modify the Service, and may update these Terms from time to time. Material changes will be communicated by email or a prominent notice on the Service; continued use after an update is acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local consumer protection law provides otherwise.
12. Privacy Policy
The data controller is the operator of Constellate (section 1). We collect and process: the text you submit during learning sessions (to power the dialogue and generate your Flashes); your learning progress and constellation data; your email address, if you sign in or make a purchase; purchase records from Gumroad (email, product, sale reference); and basic usage data. Anonymous use stores progress in your browser’s local storage. If you use an invite link, we record the referral code so the referral can be honoured, and the person who invited you may see aggregate signals (such as that their invitation led to an arrival or purchase), never your session content. We do not use advertising cookies or sell personal data.
If you sign in or make a purchase, we may occasionally email you about your own learning and about Constellate. Every such email tells you how to opt out, and you can opt out at any time by replying or contacting us (section 13); essential emails about your account, purchases, and gifts are sent regardless.
We process this data to operate and improve the Service (contract and legitimate interests), and where required, to comply with law. Improving the Service includes automatically assessing the quality of learning sessions, including with AI, and using what we learn to make the teaching better; this work uses session content with your identity removed. Your data is not used to train the underlying AI models: our AI providers process it only to deliver their service to us, and their terms do not permit them to train on it. We share data only with the categories of processors that run the Service: AI model providers, which generate session responses and help assess session quality; database, authentication, and hosting infrastructure; and our payments provider, Gumroad, Inc., the merchant of record you transact with directly at checkout. All processors are bound by data processing agreements, and where data leaves the UK or EEA, safeguards such as standard contractual clauses apply.
We keep personal data only as long as needed to provide the Service. Under UK GDPR you have the rights of access, rectification, erasure, restriction, portability, and objection, and may withdraw consent where processing rests on it. To exercise any right, contact us (section 13); we will respond within one month. You may also complain to the Information Commissioner’s Office at ico.org.uk.
